In all my trades, this is the first time ive had to do this, but feel this needs to be flagged.

I am currently in a dispute with DexterAtWarhammerWorld.

He had a thread looking for vendettas, and i had 1 for sale, so messaged him. After the usual "can i see a picture" etc, we agreed on a price.

I dispatched a couple of days later, and it arrived. Upon arrival, he sent me a message saying that it was badly painted (exact same one in photo), and that it didnt have the official forgeworld upgrade kit (the kit was never mentioned in any of our previous correspondance) and that it had a small fin missing off the back wing (again, visible in the photo) - and the price reflected these.

After a couple of messages, as a gesture of goodwill, i had offered to refund him the value he paid, minus my expenses (postage) in sending it to him. We agreed this would be a fair solution to both, and up until this morning, i thought that was what we were going with.

I sent a message yesterday asking for the tracking details for the item coming back to me, and got no reply.

Looking at my paypal this morning, i can now see that he has escalated it to a claim (so obviously has decided he wants more than the agreement we had) with the reasoning being:

Externally Damaged
Substitute
Imitation

So now it is not just a matter of it isnt what he wanted, he is accusing me of substituting it with another model.

I see he still has an active sale thread, so whilst this could all very well be a misunderstanding, i would recommend caution.

He said that to my box of NIB DKOK plus saying the box arrived empty? I'm sorry but I don't know how you can know all the models are 'damaged' and say the box is empty

Somebody kick that fraud of the site, please, im looking into filing a complaint through paypall to get him banned over there.

Check his army list thread. he says he's going to ToS at Warhammer World and will be dressed as a Mexican. Should be easy to find ...

Just got word from Paypall that they dropped his complaint.

Gave the shipping information and copy of payment.

with any luck paypal will see hes trying to claim against everyone and will stop claims.

Paypal has changed it from "being reviewed" to "Awaiting other party's response"

But can see that he has sent the following message:

Seller: That is fine. will refund as soon as i recieve.Paypal took £1.22 and royal mail was £3.65 So that leaves £25.13 to refund. Karl

Buyer: no that is not how it works you send me the full amount back to me.you send me £30.

Buyer: seller is a liar Paypal im really un happy so far with how im being treated by you as a company not protecting me.



Dont expect paypal will take too kindly to that.

Right, paypal have now come to the agreement that he will send it royal mail recorded, and will then recieve the full £30 back (leaving me out of pocket by £3.65 for the postage) but he is required to pay for the postage to get it to me.

Lets see if he goes for that.

They've been less kind to me, they closed the case, without proof of postage and without us receiving anything, so this might end up heading toward a small claims court..

Currently waiting for return. They have given him 10 days to dispatch. Will be interested to see what arrives if anything.

I have had a PM from the user in question claiming that PayPal have sided in his favour - I would therefore request that any affected parties please post an update here so we can see where we stand.

Paypal did find in his favor, as was stated in his last post - but had already offered a refund, so expect he wanted a full refund and to keep the model.

Find it silly that he can suddenly change his mind, and then say that what was sent was a counterfeit.

As far as we are concerned, this is all over now, and would recommend everyone be careful when dealing with him.

So, just to clarify, you refunded the payment but haven't received the model back? Or you have received the model now? Just trying to tie the loose ends up here.

You should be able to claim with Royal Mail, although I believe trades such as this fall under the distance selling regulations. Under which the consumer (DexterAtWarhammerWorld) has a duty of care to return the goods to you in the condition they were sent. You should mention this to Paypal.

What a scrooge. Wish people didn't like money as much as other people sometimes...

At the end of the day. People will do these things.

I wont lose any sleep over it, but will definately be more careful with next lot of sales.

Hate to see something like this happen to such an upstanding member of the site. Thanks for bringing this to everyone's attention though.

Dude.... That makes my blood boil right there....

I think in light of sending back a busted model he should be temporarily suspended, if not perminantely. It's complete disrespect. Someone who can't abide by the rules of the forum or even worse, break a model after PayPal had to be brought into it, should not be allowed to continue to trade on this site. He's posted on a thread looking for tyranids, although the model looks good he's not to be trusted IMO.

Are you kidding me? They can't do anything about that? Way to start my morning with a nice cup of RAGE.

This is typical of the nonsense for sellers in these situations.

Been screwed a few times myself, the best I can suggest is make sure you don't deal with anyone who seems the least bit shady or greedy but it can be hard to tell. This guy tried to trade me before, seemed fishy and I am glad I did not!

Shouldn't he be banned from trading here do to smashing the model in the middle of a dispute?

I'm not saying he didn't do it, from what I've read I'm sure he did, but it can't be proven so he can't be punished for it. That said I'm glad I never traded with him.

OK at this point I am going to ask people to stop with the piling on and simmer down - this is a TR designed to foster a frank exchange of facts, not a forum for everyone to chime in on their opinion of punishment. At this present time, balance of probability aside, we have one version of events. I have asked DexterAtWarhammerWorld to respond to the comment and allegation presented here and to present his side of events. Until such time, please keep your opinions to yourself. I don't want to have to lock this thread - I would like to see this straightened out as much as possible but further off-topic comment and piling on will be deleted and warnings issued. Please keep all comments strictly relating to the incident described.
