This is part of why 'copyright' is a really complicated field. I'm not a lawyer, I doubt you're a lawyer, I think we had a lawyer on here during a previous discussion about this.

I think the usual rule of thumb is that you can use other images only if they're pretty much unrecognizable. Of course, there can be a loophole if you're "making a statement."


The Real World rule of thumb is they have lawyers on retainer and a deeper pocket than you do. If they decide to go after you, even if you are 100% right, its going to cost beaucoup bucks, personal bankruptcy to follow.

Seeing as there's a discussion going on this, i'll butt in:

If I want to do say, a DKoK army, but there are no available heads for cheap. If i sculpt my own, reproduce them in resin, and make 300 to fill my own army, is that ok?

If I then market them online as "28mm Sci-Fi German Gas Mask Heads" is that ok?

Actually that's not what I want to do. But I can see people getting away with doing just that, considering that DKoK are so obviously inspired by historical german soldiers.

What I want to do is produce my own Krootox and Knarlocs for a possible Kroot army. For personal use and perhaps sale. Knarlocs seem to come in all shapes and sizes, so coming up with a personal design for them shouldnt be too hard. Maybe I could build "Alien Riding Beasts" and "Mutated Gorilla" models, but the head design seems pretty prohibitively unique IP.

its funny how they can rob everyone else of there designs and ideas in ways that are too obvious to even argue about, but anything that looks remotely like their creations would be considered theft of IP.
