I left him another voice mail on Tuesday. He now has my home, cell AND work numbers.

I hope he gets in touch with me... or someone... I'm certain everyone would be willing to work with him, if he'd just get -and stay- in touch.
Hopefully, it's something like the "Lormax" situation, in that everything will work out in the end.

After some discussion regarging my situation with some people much, much wiser than myself, I have decided to do the following:

I am going to be mailing Brad a notarized letter basically stating that he has had my stuff for x amount of time and if I do not have it back by X date I am going to be taking him to small claims court, which apparently I can do even though I'm in a different country than him.

That way if he accepts the letter, I know that he is ignoring my emails for a reason, and I can begin civil action against him.

FWIW, notarization isn't going to really do anything for you. Notarization is only an official seal which says "Yep. The person whose name is at the bottom of this document is really who signed it. I know because he signed in my presence."
I have been a notary.
It really won't help your cause.
It won't HURT... it just won't help.

Sending the letter is a good idea, though. Make sure you spring the extra funds to have is sent with a signature required. Just sending it to his address won't mean anything as -in a worst case scenario- he could always just say it never arrived. Even with a delivery receipt.

You want a signature that shows someone (and who) received it.

I know it won;t give me any extra legal weight, but I consider it more of a "cover my bases" type of thing.

And yes, it obviously will be sent registered mail.

Perhaps you're a basement hermit in your parents' house, but family emergencies cause people to drop everything and deal with them.

Then again, he could have dropped a phone call telling everyone he was pausing work.

While what you say makes sense, I dont 100% agree with you. Everyone has real life issues that come up and its not really fair to judge them completely because they had a single incident where real life issues got in the way, especially when the person has had plenty of deals that have gone completely fine in the past. While it would be nice that they inform you of their issues and a possible delay in getting the models back, saying you should never deal with the person because of one issue that came up, just seems really unfair.

Real life issues or not, a simple mass e-mail from this guy saying "Hey, something has come up and ill be busy for a few" would have prevented the whole thing. To me that is just common good practice to do just that, espically if you have deadlines or a timetable to keep up on.

If a loved one of mine was going through what Brad's loved one was going through, painting stuff would be the last thing on my mind. Notifying the people whom I am painting for would be slightly higher on that list, but not by much.

I don't blame him for a second for taking care of his family first. Family ALWAYS comes first.

No, I understand it quite well. However you cannot tell me with a straight face that in todays day and age of communication that someone couldn't find the 60 seconds or so to sit down, type a few brief words, and hit send on the screen.

Hell I can track shipping orders and send out alerts from my cell phone while doing a class two download instead of reading this months Readers Digest if I really wanted to!

Guys, especially jp400, while I agree the painter could have helped everyone by sending out an email, the purpose of the thread is not to discuss that.

Swap mods have repeatedly asked users to keep on topic.

It spoils the usefulness of these threads if you keep going off topic.
