I think this would be the same as the bomb squigs from before about hitting fliers.

If it is shooting and can't be snap fired, then hence it cannot be fired

Actually, it was decided bomb squigs COULD hit flyers if the Tankbustas weren't in a vehicle that moved

Who decided? because you cant overwatch them per the FAQ... ie they cant be snapfired.

Bomb squigs are not 'weapons' they are special wargear. They cannot be used to attack a Flyer from a transport, because in that situation, they count as a fired weapon. This is a similar argument to the Mawloc's TFTD special rule.

Greebo had spent an irritating two minutes in that box. Technically, a cat locked in a box may be alive or it may be dead. You never know until you look. In fact, the mere act of opening the box will determine the state of the cat, although in this case there were three determinate states the cat could be in: these being Alive, Dead, and Bloody Furious.

Skyfire
A model with this special rule, or that is firing a weapon with this special rule fires using its normal Ballistic Skill when shooting at Flyers, Flying Monstrous Creatures and Skimmers. Unless it also has the Interceptor special rule, it can only fire snap shots against other targets.

If your firing at a flier, check to see if you have Skyfire. If you do, use the models normal BS. If not, its snap fire.

If a model is forced to make Snap Shots rather than shoot normally, then its Ballistic Skill is counted as being 1 for the purpose of those shots. Some weapon types, such as Template and Ordnance, or those that have certain special rules, such as Blast, cannot be fired as Snap Shots. It's important to note that any shooting attack that does not use a Ballistic Skill - such as the Necron Monolith's portal of exile - cannot be 'fired' as a Snap Shot.

Its by the wording of these two rules that they create an 'on/off' switch to firing at fliers with full BS. The Death Ray is special weapon outlined by snap shots and is not allowed to be Snap Fired. With this in mind, if you declare your Skyfire rule for the shooting phase to shoot the Death Ray at other fliers, any models that are not Fliers, FMC, or Skimmers underneath the beam path are not hit; the rules for Skyfire have stated that to hit them, they must be snap fired at. Since the Death Ray cannot be snap fired, those models are not hit. The rules also work conversely when firing at ground targets and the beam moves over a flier model.
