I agree with you. But I think the point is that statutory rape can result in a case in which both parties actually want to have sex, but one party cannot legally consent. It is rape, but is it still forcible if both parties want it to happen?
Edit: Just for the record, I'm not really sure it matters enough to really make the distinction, but I can see how someone might make the argument, especially if both parties are close in age.

Just because something is taken without consent doesn't mean it is taken by force. Otherwise armed robbery, theft, fraud, and handling stolen goods would all be the same crime. Someone willingly giving you something that isn't theirs to give is not the same as taking it forcibly at gun point.

Vice principal Dunaway testified that the girl was responsible for herself once she entered the bathroom, according the brief.
Schools always have a duty of care over pupils. The whole system at this place is rotten. Downplaying incidents such as this as 'inappropriate touching' and destroying other records or not recording them is disgusting.
Clearly they're to lazy or don't want to know. The aide shouldn't get the blame here, all the senior staff should be ripped to pieces for a dereliction of duty to the children. It would be interesting to check if there's any connection between this rapist and any teacher or governor in the school.
I love how they said the girl was responsible for herself once she entered the bathroom and yet she was a minor and from the article it doesn't seem like they had the girls legal guardians present when they tried to get the girl to agree. It seems to me like they got caught doing something they shouldn't and tried to pass the buck.
Plus I hate how the kid had the charges dismissed because he's a minor, he got away with at least one instance of rape. Dude should be in jail having meetings in the e block bathroom with some 300 pound guy named Butch!

According to the movies, the only two times rape is acceptable is when it is used as state-not-quite-sanctioned punishment (in a comedy) and in those movies your wife insists on watching and reeinacting with you that make you really, really uncomfortable. But mostly comedies. Bonus points if a gorilla is involved.
*It's really weird how most Americans can think something horrible and inhumane and traumatic is suddenly totally cool if it happens to a guy in an orange jumpsuit. But only in movies, right?
what the feth is this? the guy should be arrested, and branded with a large "R" on his forehead. all of the staff related with this entire incident should be shot through the right hand and branded on the forehead with "Idiot"

Brain rebooting. Anyway, anyone see the movie "Kids"? (1995) looking like this OP has taken a page from it.
People in charge of children are in a position of responsibility: determining risk above what they are responsible for (schooling) is the sole responsibility of the parent/guardian, not theirs.
A member of the educational staff asked the child to "consent" to meeting with the child-predator, claiming the was also solely responsible for their decisions is such complete BS it is angering.
Oh well, here is hoping correction and justice works itself out in the end.
