It's not about where those individual elements came from reqlly, it's more about the whole. And that I feel is pretty unique and original in 40k.
But doesn't GW claim that they have the sole ownership of words, or stuff like swords and not just specific designes, but all swords made for models of the scale etc?
I don't really see what your point is... Yes, they have protected words and other intellectual property. That doesn't mean they shoot down, or even legally could if they wanted to, everything that is inspired by their property.
In the same way they took ideas from Dune, but there's no Fremen or Spice Melange mentioned in 40k.
What have you never seen or your self had an idea and then found out it already exists
It happens all the time to everybody! I think sometimes people underestimate just how many ideas that overlap billions of people will have :p
That said, 40k is definitely and explicitly inspired by many pre existing properties. Inspiration isn't infringement.

In the 1st edition rulebook, the Imperial Army is described as being "highly trained and usually, well equipped and led". It doesn't have the idea that planets' populations are tithed off as conscripts - that might have come in in 2nd edition - but that idea reminds me of British imperial troops as used in the World Wars - ANZACs, South Africans, Canadians, Indians and more.

So the moral of the story is ... if you can steal enough from everyone else around you and then misspell what you stole, you're allowed to make millions off it but sue anyone into the ground that tries to steal from you?

I love this grim dark universe, you can see some clean influences like:
- The dark age of imperium: Isaac Asimov Foundation
- Space marines: Starship troopers (the book)
- Tyranids: Alien film
Is not 100% original, but i f**king love this universe, cool as hell

Yes but you can say tyranids came from someone thinking about a bunch of different insects in real life too  . Its like what was stated earilier, some one can imagine some thing and then find out that idea already exists. Any way i love the 40k universe.
Google "Weta" that's a nasty looking insect that could help inspire at least some of a tyranid
