I considered using beastmen. It's even more likely now that Maxmini has put out their AK-47 mini's. That would give them the look of scruffy low-lifes that appeals to my antisocial nature.

A snazzy orange paint job can go miles to make even the most vanilla Cadian look like Penal Legion scum.

I would definitely go with Catachans if I was ever to make any, however, since they're supposed to be grizzled, hardened and probably roided out something fierce.

I would suggest that the penal legions could be equiped in not a disimilar fashion to regular guardsmen, therefore you can use regular guard minis without worry, maybe a more rag tag paint job/weathering. Those new ugly GW guard heads might also help with this deshevalled look, including some crude bionics/alterations.

Personally I will am using the oldest guard stuff I have mixed with the current plastic kits. From my own collection I have a choice of metal RT era Imperial Army (they are a little smaller than the current ranges though) and my preferred choice which will be cadian/catachan legs/torsos with the atiquated Ryza pattern lasgun weaponry/equipment (from the first plastic guard kit). These troops will be a mis-mash which I think represents the generally random look a penal legion should have. Of course there is also the option of using a mix of any SF minis you have to represent a ragtag band.

It really is a great opportunity to model something a little differant in an otherwise uniform army.

I used the warrior of chaos heads on catachan bodies with the horns cut and filed off, was thinking of painting jeans and orange vests also i foung flagellent heads can be quite fun, also the banner and shackles on there arms can creae a nice look. On the other hand if your a red dwarf fan look up the canaries they were a deep space penal legion incorparating a black and yellow paint scheme

I went the easy route and picked up some of the old metal Cadians. Their kit looks nicely out of date.
