A bank foreclosure story you've got to see to believe. A Collier County couple turns the tables on Bank of America, the bank that tried to foreclose on their home. Now, the family is foreclosing on the bank! Even bringing trucks and deputies ready to seize property.
The foreclosure nightmare started when Warren and Maureen Nyerges paid cash for a home owned by Bank of American in the Golden Gate Estates. They never had a mortgage whatsoever. But, the bank fouled it up and wound up issuing a foreclosure through their attorney.
The couple took their case to court and after a year and a half nightmare the foreclosure was dropped. A Collier County judge said Bank of America has to pay the couple's $2,534 legal fees for the error. After more than five months the bank still hadn't paid up. So, the homeowners' attorney did just what the bank would do to get their money, legally seize their assets.
"I instructed the deputy to go in and take desks, computers, copiers, filing cabinets, including cash in the drawers," Attorney Todd Allen told WINK News.
Outside the Bank of America on Davis Boulevard, several deputies stood by with movers ready to start hauling out the bank's office supplies and furniture.
Inside, the homeowners' attorney was locked out of the bank manager's office by deputies while the bank manger tried to figure out what to do.
Allen says the manager was visibly shaken, "Having two Sheriff's deputies sitting across your desk, and a lawyer standing behind them, demanding whatever assets are in the bank can be intimidating. But, so is having your home foreclosed on when it wasn't right."
After about an hour the bank finally cut a check to satisfy the debt, and no furniture was taken. A representative for Bank of America issued a statement saying they are sorry for the delay in issuing funds. They claim the original request went to an outside attorney who is no longer in business.
As for Allen, he calls this a symptom of a larger problem he sees often in the courts, where banks don't perform their due diligence on foreclosure cases. "As a foreclosure defense attorney this is sweet justice."

They do right now. Lying, cheating, and, occasionally, stealing are time honored and honest professions. They must be, as we reward the people that do these things well with large amounts of money.

It amazes me that ordinary people still use the large banks when credit unions are so much nicer to their customers. Bank of America tacks on fee on top of fee, while the credit union I'm with prides themselves on sorting out people's financial issues and getting their debt manageable.
Credit unions have different regulations than banks and can in fact do thus. They were originally created only for the employees of a particular institution.

It's amusing, because of their origins credit unions have to limit their new membership to a particular group, so it used to be fairly narrow groups, like a small community or one of a few businesses and not anyone could get in. But since the law doesn't require it to be a hard group to get into, they can be pretty much open membership in practice. For example one credit union opens it's membership to anyone who springs for a $10 lifetime membership in a 'educational financial club.'

I used to goto big name banks, and they all just screwed myself and my wife over many many times. The worst personally was Chase. Holy gak they were some snake tongued mofos. They would bunch up my purchases I made on my debit card for about 3 or 4 weeks, and then pull them all out at once. And then charge me over draft fees up the whazoo.
Ive been a member of a credit union for a good 4 or 5 years now, and never EVER had a problem with them since I joined.

My credit union deliberately does the opposite, their policy is that if you have multiple overdrafts, they'll order them so that you end up with as few hits as possible, and they don't drag them out. Plus you can set up your checking account to automatically cover overdrafts from any of your savings type accounts or your credit card, so you have to be pretty broke to actually even get an overdraft fee instead of a warning that the protection was used.

Thats what Im saying, Credit Unions are great. Big name banks are friggin con artists. I remember once I was looking at my statement when I was still with Chase and saw all these odd charges. So I called and I kid you not, I was getting feed for using my debit card more then I dunno like 3 times a week. So I stopped using it and would pull cash instead to cover things. Well then I got a fee for NOT using my card X amount of times a month.WTF?!

I go to big name banks because my debt is already manageable, and they give me better rates on my accounts. I imagine many people are the same, but I also imagine that many people do so out of ignorance, and/or desperation.
