There is no best army. There are many amazing armies, but not a singular best army.
If you're looking for an army to start, then choose one that you like the fluff for, then look into the different builds for that race.

You want the best army/build but you don't want cheese as you want it for friendly games. You cannot have the best army build without cheese. You also can't have the "best" list so you can win every time for friendly games. Everything you have said you wanted contradicts each other. If you want compatative I think your bes bet would be Dark Eldar Venom Spam.

That is the most useless question it is possible to ask in this forum.
Refine your question. Define what parameters you mean by "best", because by the second criteria you stated you don't mean "most likely to win."
Even refined for reasonable criteria, it is still far too broad a question. There is no "best". There is "best against this specific opponent/build" and "best at achieving X particular goal" or even "best for a new player to learn with", but "absolute best" is a nonexistent goal.
Please rephrase in a more useful way.

Having "the best army" means nothing if you don't know how to play it or it doesn't fit your play style. In friendly games almost any army can win, some just require more skill. Without cheese? Now that's just bad. Just about every army played uses "cheesy" stuff because it plays to the codex's strengths.

The best army, without a doubt, is Tau. Be sure to use 2 Etherals in your HQ slots, and avoid overly complicated models like Crisis suits and broadsides.

First of all, that tau list is pwnage, no doubt about it.
Secondly, I mean I want an army thats obviously cheesy enough to win against my opponents.(Imperial guard with lots of tanks/Weapons teams, Grey knights with kaldor but not draigowing exactly, Black Templars, Blood Angels 1 with sanguinary and death company+DC dreadnought and dante+astorath, and the other with death company spam.)
But I dont want to mercilessly crush them to oblivion.

You keep asking a very stupid question.
You are not stupid mind you (that is to satisfy all those moderators out there) you are just a bit unsoiled to the dirtier parts of 40k.
Do not search for the best army. It is merly about finding the moast shots for the cheapest price. Pick one army your like the looks of. Grab some of the units you want to use. Build your army around it.

A very general answer is there are stronger codexes out there, try perhaps BA, SW or GK's if you like marines or Orks or DE if your a xenos man/lady

Wait a bit and jump on the Necron bandwagon when it stops by your neighborhood. New units and abilities that should (could?) be very competetive in the current meta might translate into enjoyable games for all involved.

If you want to have a decided advantage on the game, play GK.
Whoever wrote that codex did not have an understanding of the relationship between STR and AV/Toughness. They did not realize that if you increase the STR of weapons by one, it has significant impact on performance. STR 8 AC, STR 7 psycannons, STR 7 AC. All these give the GKs a power advantage in the game.
The other broken thing are henchmen. The most apparent of these are DCAs, with enough PW attacks. These models can out-assault TH/SS termies and run nearly 1/3 the cost.
Playing this army will not guarantee you a win. I would say its about 25% more effective than other codex's out right now. In the hands of a new general, it will not give them the advantage over a skilled general. It matters between two generals of equal skill. There is a reason that GK lists are going to the top in tourneys.
