A Republican lawmaker in New Mexico introduced a bill on Wednesday that would legally require victims of rape to carry their pregnancies to term in order to use the fetus as evidence for a sexual assault trial.
House Bill 206, introduced by state Rep. Cathrynn Brown (R), would charge a rape victim who ended her pregnancy with a third-degree felony for "tampering with evidence."
“Tampering with evidence shall include procuring or facilitating an abortion, or compelling or coercing another to obtain an abortion, of a fetus that is the result of criminal sexual penetration or incest with the intent to destroy evidence of the crime," the bill says.
Third-degree felonies in New Mexico carry a sentence of up to three years in prison.
Pat Davis of ProgressNow New Mexico, a progressive nonprofit opposing the bill, called it "blatantly unconstitutional" on Thursday.
“The bill turns victims of rape and incest into felons and forces them to become incubators of evidence for the state,” he said. “According to Republican philosophy, victims who are ‘legitimately raped’ will now have to carry the fetus to term in order to prove their case.“
The bill is unlikely to pass, as Democrats have a majority in both chambers of New Mexico's state legislature.
UPDATE: 12:25 p.m. -- Brown said in a statement Thursday that she introduced the bill with the goal of punishing the person who commits incest or rape and then procures or facilitates an abortion to destroy the evidence of the crime.
“New Mexico needs to strengthen its laws to deter sex offenders,” said Brown. “By adding this law in New Mexico, we can help to protect women across our state.”

The proper counter is for the abortion clinic to retain part of the foetus for DNA analysis.

This is likely the symptom of you not paying enough attention to their financial shenanigans. If anything, their fiscal polices are even more ridiculous. I mean, making a load of noise about deficits in the 90s, working with the democratic president to balance the budget, then immediately cutting taxes and putting the country into deficit and happily staying so until a Democrat comes to office and then getting all concerned about deficits again... that is not sensible fiscal policy.

I went to fire off a hateful missive as I often do to slowed jackasses who say stupid things. While on her webpage I took the oppourtunity to look at the tab with her bill. It reads somewhat differently than the one on the NM legislature page.

If that bill is the text that was introduced then it seems that the whole thing is just a bunch of balony.
The bill would modify an already existing law that makes it illegal to have an abortion for the sole purpose of destroying evidence. They have to be able to prove that the indent of the abortion was to destroy evidence.
The bill would add the following section to the already existing 50 year-old law
B. Tampering with evidence shall include a person
committing criminal sexual penetration or incest procuring or
facilitating an abortion, or compelling or coercing another to
obtain an abortion, of a fetus that is the result of the
person's act of criminal sexual penetration or incest with the
intent to destroy evidence of the crime. In no circumstance
shall the mother of the fetus be charged under this subsection.
So all the bill does is clarify that
A) Women shall not be charged if they are seeking an abortion out of their own will.
B) If the women is forced by a rapist to have the abortion in order to destroy evidence, then the person forcing the women (and not the woman) shall be charged with destroying evidence.
As far as I can tell, it is actually a sensible bill. But let's just take the HuffPo at face value and rage.
