Eh, I am disillusioned with the for-profit prison system and multiple decades of terrible unreliable eyewitness fake trials which put people wrongly in prison.
I think this ruling is probably 'correct' as in it is not a deterrent and is never reasonably implemented... It would remove a whole layer of dredging up trial to make it explicitly gruesome to harm the family and convince 12 people to go for death penalty.
I guess californians will have to decide via their legislature if they really care or not. I am not going to lose sleep over it regardless how the issue swings because it has terrible issues on both sides.

I'm glad. I've a fair amount contempt for punishment for punishment's sake and even more for revenge. I'm no fan of killing human beings either, so the Death Penalty is just an all around "Nope. Nope. Nope" for me. As far as I'm concerned any win against it is a good win.

Few years ago in Canada some sick was in the bus, and for no reason he cut off the head of the guy sitting next to him and then started to eat his internal organs, but since he is a sick psychopath he was released after some time in mental hospital... YOU. STUPID. IDIOTS. If a rabid dog eats a kid on the middle of the street, we are going to put him down, but if a man can't tell that cutting off the head and eating the inernal organs of some random guy in full bus is NOT WHAT SANE person would do, WE LET THEM LIVE, of course!!

But you do bring up a point. It depends on why the death penalty exists. Is it a deterrence? Or is it simply society saying "you don't deserve to live"?

That was because they simply didn't have the forensic technology then they do now.
I'm very confident convictions we get from recently onward will have a much better record. 30 years ago was a very different time.
And even if we wrongly convict a small portion of death row inmates, better that those few are wrongly executed then to let the majority get away with heinous crimes.
Unless you can prove that our current method has a huge number of false convictions then there is no good reason to suspend the Death Penalty.

We dont have the death penalty in our country. For many reasons.
The reason I am against it is due to the lack of empathy involved by those who agree with it. While prison doesnt work in rehabilitation I personally dont think killing is the right way to go about it.
I once watched a documentary of a kid who grew up in an abusive household before being adopted into a normal family and she was a typical horror story psychopathic child. Killed animals, molested and frequently harmed her brother etc. She felt no empathy because she was mentally incapable of doing so. Had she killed someone (which many kids like that do) then would she have been killed by the death penalty? Because we choose to show a lack of empathy towards someone who mentally cannot?
Of course not all killers are mentally insane. But the general opinion here is that there are far too many what ifs and buts involved in the death penalty. Too easy to make mistakes.
Plus prisons have their own justice system. No gang will let you be if you raped a kid for example. Its pretty harsh in there if you have done crimes like that. Let them beat each other up as people of their own level.
I can see some positives to the death penalty but overall it clearly doesnt work (as it seems there are a lot of people on the waiting list) but I personally find it very distasteful to wish death upon another human.

I think its better to let them waste their life in prison where they have a chance at forgiveness than kill them outright.
Remember rabies results in death naturally, without a cure. Its humane to kill a dog/human suffering from advance rabies because its a horrific death. I watched a documentary which videoed the various stages of rabies in a human and that death was not pleasant to watch. So its not a very good comparison.
