I am in entire agreement here Frazz. I stand by the "every house is a castle" doctrine too.
However, here in Britain where guns are hard to come by and shooting a burglar or otherwise will get you a massive lawsuit I find that a charging blacksmith with a spear/axe/sword/favourite hammer tends to do the trick. Even more so if their wearing the armour they made for themselves.


I think an axe and a Viking helmet would do it just fine.

What would happend to you if you go on vacations (weekend long, week long, month long, you pick) and find someone else usurping it. Happened to a friend's neighbours and local police told them (literally) best way was to pay someone to kick their asses outta the house.

That may be how it works in Argentina, but most places in the States it doesnt. Provided you can PROVE that it's your house/residence, most times the police will remove the illegal occupants

Yep. Ultimately the house is the private property of it's owner and if they wish for it to remain unlived for whatever reason then that is entirely their business.

There are perfectly legitimate reason why a house may remain unoccupied for a prolonged period:

The owner could be travelling or working abroad.
The owner could be in hospital or long term care.
The previous owner might have died and their houses inheritor may be in the process of selling it on, which depending on the housing market could take years.

You can’t just look at someone else property, deicide it’s unused and help yourself.

I agree with this, a dead thief can't lay claim to your property. The man is very brave to think people won't come after him.
If someone leaves a house permanently and abandonment is the consideration i think it should go through government auction. Otherwise it just encourages thieves like this to come out of the woodwork.

When does a property become a legitimate target for squatting? I assume they can't just break in and occupy the place when you're out to the shops so why doesn't it count as breaking and entering? Furthermore, what stops you simply forcing your way in and throwing them out?

Ten to twelve years unoccupied was permissible for squatting in the UK. Last year however squatting was made illegal in England (1865 in Scotland), so I guess the land is owned by whatever the local governing body is. The US and UK's laws vary, but it appears that the American's are bit more lenient (in terms of law, they do have guns mind) towards it, though that's not to say either is efficient in getting rid of unwanted squatters.

Wow, this guy is a deeply unpleasant person. He seems to be arguing that if theres no person physically present inside a property, then its automatically abandoned. If you go out shopping, go on holiday, go to work and school then your house is abandoned, and greedy scumbags like him can abuse and exploit the law to claim your house.

This guy deserves jail time, no doubt about it.

You know what I would do? Try to be as obnoxious as possible to the guy to try and get him out. Like, I'd have parties in the back that would last to midnight, flood the house with floodlights (Lol), sneak in stereos that would blast bad pop music, scratch the door with a rake, infest the house with cats, pump in chili gas and other such non lethal things. Best part is he can't stop you since it is your property.

If it doesn't stop him it would piss him off.

Squatter's rights and eminent domain and similar laws require a person to be using the land for many years before they kick in, so they're not really applicable here.

It's really about eviction, which for very good reason has a lot of laws and strict procedures for how you go about evicting someone from a property. And those laws are, unfortunately, exploited by donkey-caves from time to time. It isn't that the person won't get their property back, but that it often takes so much time that the person involved is tempted to pay the money. If they don't, then the squatter just stays in the house rent free until all legal avenues have been used up, and then just walks away.

What needs to happen is that clearly false claims to a property needs to have some kind of jail time. The laws need to be written carefully so they can't hammer some poor kid who's in a dispute with his rentor, but in cases where the person is making a claim to a property without ever having paid any kind of rent or having any genuine connection to the property, then they need to face jail time.

Most local governments have the ability to take your property and sell it if you don't pay your land taxes for several years. So the property might sit there getting run down, but the person will at the very least be continuing to pay taxes in to the community, effectively paying for services used by other people in the community and not by himself.
