Yes, it´s official. GW will resurrect the beloved Tomb King faction due to popular demand. These are very good times to be in the hobby and finally I can get my hands on a nice Sphinx. Jesus, I am so hyped right now.

Imagine if GW actually did this, people went berserk and they had to make amends and actually re-release kits like the Necrosphinx (whyyyy didn't I buy one). Sorta like their SoB jokes.

I can't believe you all fell for the obvious trick here. Not that Tomb Kings are coming back, but that they're never coming back. Really? You all have such little faith in GW that you think they'd just delete an entire range of models just because they couldn't trademark something based on world history? You honestly think they'd wash their hands of a lovingly crafted faction and make it useless to the people who invested hundreds of monies and hours into making their army? For shame. Next you'll tell me that they'd just blow up the oldest wargaming setting on the planet to replace it with something scribbled on the back of a napkin.

I've got some news for all you naysayers: GW already brought back Tomb Kings and they did it right under your noses. In fact they've had an entire range of them around for years and none of you noticed their bold, new direction:

1. All the Tomb Kings are alive again.
2. All the names are changed and some of the units are different. For example, the Necrosphinx is now just a sphinx and it's also inanimate. And you have to buy the model somewhere else, preferably a tourist stall in Egypt.
3. All of the available models are hosted on a different site to Games Workshop's.

I've never understood people who think that TK were removed due to trademarking. Especially when Daughters of Khaine are running around with medusa and harpis and heck the recent Slaanesh update has Keeper-Xerses from the 300 film.

Nothing GW produces can be protected as a concept by copyright or trademark. Dwarves with airships; half snake people; men wearing power armour; ww1 style infantry - etc...
GW can protect the specific sculpts, the lore, the name and suchlike, but the actual concept can't be protected at all. Heck there's several very large 3rd party companies that make alternate army lines and such without legal issues.

TK were, far as we are aware, dropped due to lack of sales. Lets not forget AoS at launch was a totally different product. It wasn't a traditional wargame and GW weren't marketing nor building it as one. It's changed and GW of today would likely not have dropped TK if they were still around. As for bringing them back - we can cross our fingers and hope.

GW can't trademark dwarves, elves, or power armour, but they can trademark and copyright designs, such as specific Aelvean symbols, styles, units, etc. The name changes and refinement of symbols are so that and third-party will have to make "not-GW-Duardian Dwarves in Blimps" and generic, non-space marine look power armour models.

Tomb Kings on the other hand are highly generic because they are both undead and Egyptian based. You can't trademark myths such as sphinx, or generic skeletons, or Egyptian Pharaoh inspired headgear on a skeleton.

You can't trademark a sphinx but you could a sphinxis
It's the same as you can't trademark medusa but you can trademark a Bloodsister who is a Melusai.

I agree, it's a ridiculous idea to think GW would act in a litigious manner to trademark terms they didn't invent. By the way, I'm really enjoying all the new Orruks and Ogors!

I don't think Tomb Kings have the same chance of success as plastic Sisters, being on the fantasy side and I'd bet even more niche, but there's no harm in trying.
