Subject: Ork - Scratch built and Converted models (and some Chaos)
SJM wrote: Ahh I see, tbh I think its awesome, I'd be over the moon if something I created made it into a official book!
However, that said credit should given somewhere for the use of your model.
trust me mate, i am over the moon, but GW need to do the right thing now, so lets see what they do
I think a nod towards your awesome skills and a lifetime supply of plasticard?
Atleast that way they would never need come up with original artwork or design..... they could simply put all your stuff into production
Favourite Game: When your Warboss on bike wrecks 3 vehicles simply by HoW - especially when his bike is a custom monowheel.
It's great that your work is shown, but someone at GW will be taking credit for creating it. If you took a model of, let's say. Ragnar and painted a painting of it, exactly like the model shows, then you'd have a bunch of GW lawyers racing to see the state of your colon. It looks like a photoshop job to me rather than a traditional painting, hence it's a photo manipulation rather than a painting. I've always been about giving credit where credit is due, your Orkiness is what most of us (i think) think how orks put stuff together.
It's awesome that some of us know about it now, but it still sucks that not everyone does.

As a graphic designer, I imagine that the image in the book was done by a freelancer. That artist cobbled together the image from other sources, and blended it all together into a uniform image. They sent that image in with any of others that they were working on, signed the release saying that the work was theirs and got their check. GW legal probably didn't bother to run all the elements of all the images, planning to just go back to their releases if there was trouble. Most likely they'll just burn the designer and claim it wasn't their responsibility.
At the end of the day, though, I would be surprised if they respond. Unless there are lawyers sending them letters, they probably don't care. Maybe not, but it seems that their legal department is about offense rather than defense.
Congrats anyway on getting published. If I were GW, I'd be calling you to buy your work for their new ork lines.

I agree with mars2024 that it was probably done by a freelancer. If it was, find out if you can get the freelancer's information from GW and talk to them about it if GW's hands are tied.

1. the painting was done by a freelance artist who was employed by GW 2. GW put the painting in the book (The Red Waaagh) thinking the Artist had not copied anyone else's work
3. GW are responsible for all work they print, seeing as the Artist was an employee/freelance, they are still responsible for what the print in there books
4. UK copy write law is very clear (LOL) as GW know and have been using ageist many people in the uk ove the last 10 years or so
dont get me wrong guys, i love GW and there models, i hate there prices.
again guys i will say this, all i want is GW to do the right thing, so let just see what that is, they said they will reply to me this week.
I really hope they do the right thing by you Wazz... even a verbal aknowledgement of your contribution would be a big step.
Would really like not to be pissed at GW for their business practices all the time. Here's hoping they come through & let us know there are actual human beings on the other side of the corperation "fence".

You mentioned the deffkoptas being Nobz because they have two wounds. I dont think they are, I think they just have two wounds to represent the the heap of scrap they're flying around.
Cool stuff as always anyway, man.

yeah i have been corrected a lot over that comment, what i was getting at is the body of the pilot is way to big for a normal boy head, so thats why i have put knob heads on them plus they have 2 hits, oh well lol
Wazz'a mate, good luck with the GW thing its still great to see your outstanding stuff in one of their books, lets hope they do the right thing by you..........
Right guys, here is what has gone off, a Freelance artist, did the painting in the book "The Red Waagh", he copied my model "Da Belly Buster" thinking it was a GW model (so he says) then GW put it in there book, and printed it, this broke a copy right law, i then told them this has happened, they said there really sorry, we need to do they right thing.
i have been offered a lots of plastic crack (when i say a lot i mean a lot) and a framed copy of the Art work, plus they may well do a photo shoot in the future with Da Belly Buster.
In my opinion i feel this is very fare and i do think GW have indeed done the right thing, i can't stop smiling, hahahahaha
I think that, given the circumstances, this is really the best possible outcome: They were never going to grant you royalties from the gig, but it's arguably the next best thing.
It's good to see that they treated this case the way they did. If anything, GW should actually make it a policy to include hobbyists' models in their army books, codices and big rulebooks again!
And when all is said and done, your model appears in a Codex, and in a piece of artwork, not a standard photo -- I mean, how cool is that?
Lastly, it think it should also be pointed out that you really reacted in a very cool way, not slamming GW for idea theft, but also trying to protect your interests. Thumbs up for the very levelheaded approach from all parties involved
...
...except for the freelancer, whose body will now probably be found floating by the docks
