I think you're using overly broad terms with "cleared all of this stuff up ages ago."
What they did, in fact, was confirm that the parts they were making were -in that lawyer's professional opinion- clear of any copyright/IP violations.
Look more closely at what the lawyers have been saying.

It's fairly universal that they're saying (a) the add on bits are probably fine (b) the usage of GW terminology is risky, at best and (c) certain larger kits he manufactures/sells may or may not be to his detriment.

Now, granted, those are my own words. One of my close friends is a lawyer, though and they tend to speak in generalities outside the courtroom (on legal matters, anyway), whenever the law on the subject at hand is at all murky.

I hope the lawyerly types here will correct anything I've said in error or support that which is correct.
(I say that as a preemptive strike, because it's in their nature to do so, anyway. )

Fast approaching? Seriously? You're comparing a company like GW that rakes in $50 million a year to some garage kit company that is lucky to do $10K in the same span. So, is GW so insecure because of how niche they are? Because Hasbro/Takara Tomy has no problem(according to their own Q&A at Botcon one year)as long as 3rd Party products don't pierce an (arguably) arbitrary ceiling(iirc, around $100 USD). Hell, some of the companies even get booths at Botcon(yes, I know that Botcon isn't technically run by Hasbro itself these days, but it's still the "official" convention and advertised by Hasbro).

Well thats one of the points of the lawsuit....... people can't tell them apart. I just wonder if they will fire the employee for using ch parts on her models. That would be funny in one of those horrible funny ways. Maybe she even bought the entire army at a huge discount from ebay.... now that would be really messed up.

If people are confused...then GW is doing the confusing.

"This command squad was converted using parts from the Dark Angels Veterans kit and the Space Marine Command Squad. The banner bearer is available to order and his banner can be found on page 58 of Codex: Dark Angels. Kristian has also used several parts from other kits, most notably the Empire Flagellants, from which he has taken the head and the back banner for his squad sergeant."

That would imply that the shoulderpad on the SGT could be found in one of the kits named in the article.

Might want to bone up on your english...... that doesn't imply that at all. It would have to say only she used parts only from those kits for what you said to be true.
